These terms govern your use of shadowandpalm.com ("Shadow & Palm", "we", "us"). By creating an account or using the site you agree to them. If you don't agree, don't use it.
1. Who can use this
Shadow & Palm is about alcohol. You must be of legal drinking age in the place where you live, and at least 18, to create an account or use member features. If you are under the legal drinking age, do not create an account.
Please enjoy responsibly.
2. Your account
Accounts currently require an invite code. Give accurate details, keep your password to yourself, and tell us if you think your account has been compromised. You are responsible for what happens under your account. Passwords are stored by our sign-in provider, Amazon Cognito, not by us.
3. Recipes are suggestions
Recipes, substitutions and suggestions on the site are information, not instructions you must follow. Recipes generated by AI (the Lab, Concierge and Tonight suggestions) are suggestions only: they can be wrong, unbalanced, or unsuitable. You are responsible for deciding whether a drink is safe for you — including allergies, intolerances, medications, pregnancy, and how much you drink. Check ingredients yourself. Do not drive after drinking. Alcohol is not suitable for everyone.
Historical notes in the catalog are drawn from our records and may be incomplete; where a recipe has no documented origin, we leave it blank rather than guess.
4. AI features
The AI Lab, photo and shelf scans, and Concierge/Tonight suggestions are processed by an AI model on AWS Bedrock. AI features have usage limits that may change. We may limit, pause or end AI features at any time, including to control cost. Results from a photo scan are candidates you confirm — check them before saving. Don't submit photos or text you have no right to submit, or that show other people.
5. Your content
You own what you put in: your bar, notes, photos, and recipes you write or submit. By submitting it you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, resize, and display it as needed to run the service. If you make a recipe visible to the community, it is visible to everyone, including people who aren't signed in, and credited to your display name, or to "A Shadow & Palm member" if you have not chosen one.
For a community recipe that we adopt into the main library, the license is perpetual and irrevocable, and the recipe stays after you delete your account, with its original credit.
Only submit content you have the right to share. Do not paste recipes, text or photos you copied from a book, website or someone else's work. Facts such as ingredients and measures are fine; someone else's written descriptions are not. You can delete your content, or your whole account, at any time; deleting a community recipe or your account removes it from the service, except recipes we have already adopted into the main library.
The rest of the site — the catalog's text, design, and compiled data — belongs to us or our licensors. Don't scrape it, republish it wholesale, or use it to train a competing product. This also prohibits using the site's content or compiled data to train AI models. Personal use and linking are welcome.
6. Acceptable use
Don't: break the law; use the service to encourage underage or excessive drinking; harass anyone; upload unlawful, infringing or hateful content; probe, overload or attack the service; get around limits or quotas; use bots or scrapers; or resell access.
7. Ending things
You can stop and delete your account whenever you like from the account page. We may suspend or end your account, remove content, or limit features if you break these terms, abuse the service, create risk or cost for us, or if we must for legal reasons. Where reasonable we will tell you why. Sections that by their nature should survive (content license for material others have already received, disclaimers, liability limits, governing law) do.
8. Privacy
How we handle your data is in our Privacy Policy.
9. Disclaimers
The service is provided "as is" and "as available". We don't promise it will be uninterrupted, error-free, or that any recipe, scan result, suggestion or note is accurate or fit for a purpose. To the fullest extent the law allows, we disclaim all warranties, express or implied.
10. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of the service. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or US$50. We aren't liable for harm from drinking, allergic reactions, or how you use a recipe. Nothing here limits liability that cannot be limited by law (for example for fraud, or where consumer law gives you rights that can't be waived).
11. Changes
We may update these terms or the service. If a change matters, we'll update the date and version and, for account holders, tell you by email. Continuing to use the service after a change means you accept it.
12. Governing law
These terms are governed by the laws of the State of Florida, United States; courts located in Florida hear disputes, except where your local consumer law says otherwise.
